Terms and Conditions (T&C) of Innsbruck Flughafen Taxi

1. Scope of Application

1.1. These Terms and Conditions (T&C) apply to all transportation services provided by Innsbruck Flughafen Taxi and in the legal person of Gökhan Aydin, based in Innsbruck, Austria.
1.2. Deviating terms and conditions from customers will only be recognized if expressly confirmed in writing by Innsbruck Flughafen Taxi.

2. Conclusion of Contract

2.1. The contract between the customer and Innsbruck Flughafen Taxi is concluded upon acceptance of a booking made by phone, in writing, electronically, or verbally.
2.2. Innsbruck Flughafen Taxi reserves the right to decline bookings without providing a reason.

3. Services

3.1. Innsbruck Flughafen Taxi undertakes to perform the agreed transportation services diligently and reliably.
3.2. Pickup times and travel routes are determined in agreement with the customer. Delays caused by traffic, weather, force majeure, or unforeseen events do not constitute grounds for claims for damages.
3.3. Special requests from the customer (e.g., child seats, specific vehicle types) must be communicated at the time of booking.

4. Prices and Payment Terms

4.1. Prices are based on the applicable tariff regulations of the City of Innsbruck or individually agreed-upon rates.
4.2. Additional costs, such as waiting times, luggage fees, or extra services, will be charged according to the current price list.
4.3. Payments can be made in cash, by credit card, or via other accepted payment methods. The fare must be paid immediately upon completion of the trip.
4.4. For advance bookings, a deposit may be required.

5. Cancellation and No-Show

5.1. Cancellations must be made at least 24 hours prior to the agreed pickup time.
5.2. In the event of late cancellations or no-shows, Innsbruck Flughafen Taxi reserves the right to charge a cancellation fee of 100% of the fare. The cancellation up to 48 hours before the journey is free of charge, from 24 hours before the start of the journey a 50% cancellation fee and the fare is 100% paid for at less than 24 hours before the journey starts.
5.3. If the driver cannot proceed with the trip due to inaccurate or incomplete information provided by the customer (e.g., incorrect address), it will be considered a no-show.

6. Customer Obligations

6.1. The customer is required to follow the instructions of the driver during the trip.
6.2. Any damage caused by the customer or their companions to the vehicle must be compensated in full by the customer.
6.3. Transporting dangerous, illegal, or prohibited items is not allowed.

7. Liability

7.1. Innsbruck Flughafen Taxi is only liable for damages caused by gross negligence or willful misconduct. Liability for minor negligence is excluded unless essential contractual obligations have been violated.
7.2. Innsbruck Flughafen Taxi is not liable for delays caused by traffic conditions, weather, force majeure, or other unforeseeable circumstances.
7.3. Innsbruck Flughafen Taxi assumes no liability for valuables left in the vehicle by the customer.

8. Data Protection

8.1. Personal data provided by the customer will be used solely for the fulfillment of agreed-upon services.
8.2. Data will only be shared with third parties if required for the performance of the contract or if legally mandated.

9. Jurisdiction and Applicable Law

9.1. Austrian law applies exclusively.
9.2. The place of jurisdiction for all disputes is Innsbruck, unless mandatory legal provisions specify otherwise.

10. Final Provisions

10.1. If any provision of these T&C is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected.
10.2. Amendments or additions to these T&C must be made in writing.
